How long should it take to collect?It can take anywhere from one week to a couple of years depending on whether or not the Defendant puts up an agressive fight, and how busy the Courts are. It is also possible, but not common that the debt could be uncollectable.
Can I expect to win?Everyone wants to know what will happen. In the 100's of sales rep cases I have dealt with, I have found remarkable similarities that render most outcomes predictable, and we are confident that our assessment should be accurate. Although our firm wins the majority of commission collection cases, we cannot guarantee any specific outcome in your case.
What do you need from me?
Basically, we need a signed contract, a termination notice (if you've received one) and a breakdown of how you've arrived at what's owed.
What are typical up-front costs?If a demand letter is unsuccessful, then we'd have to work with you to determine if you want to go to the next step and file a lawsuit. Filing fees in California are about $400. There are also filing and service of process fees. Most clients send $600 to cover these initial costs.
